Scope and Content
Reciting mortgage of 25 March 1867.
On completion title deeds were handed over to John Thomas Green, attorney for E A Green
On 28 October 1874 i) being indebted to Samuel Higgins for £80 declared that title deeds should be retained by J T Green as attorney for ii) to secure repayment of £80 and interest (such sum not to be called in by ii) for term of 3 years). i) agreed to execute a proper legal mortgage for same when called on to do so.
£90 is now owing to ii) for principal, interest and costs and ii) has asked i) to execute said legal mortgage
Now in consideration of £90
i) as to property firstly described, appoint, and as to property 1stly and 2ndly described, grant
- property as in X395/95 to use of ii) subject to mortgage, principal sum and interest and repayment of said £90 and interest at 5% p.a. Power of sale in case of default.
