  • Title
Draft of an agreement in Chancery between plaintiff John Field and defendants Ann Field, widow of Thomas Field, Joseph Margetts Pierson, Charles Nicholls Field, gent, and Charles Nicholls Field, infant. To avoid expense and delay, all parties agree to waive entering any proof to this hearing. Ann Field and Charles Nicholls Field, gent, admit the will of Charles Nicholls deceased and that John Field is not only his heir at law, but also the heir of Thomas Field esq, his late brother, and of Charles Nicholls Field, son of Thomas, who died unmarried. They also agree that John Field lent Charles Nicholls 200. The plaintiffs ask the Master of the Rolls to enquire whether Thomas Field was indebted to Charles Nicholls at his death and by how much. - Ann Field agrees to waive all right of dower to any of her husband's real estate and only to claim the life estate devised to her in his will. - Charles Nicholls Field, gent, agrees to waive all right to Bushey Close, Higham Gobion, and to release it to John Field and his heirs. He submits to account the rents and profits he took from the estate to recompense himself for the arrears of his 50 annuity, because John Field has confirmed the annuity and undertakes to pay it regularly. - all parties agree an account should be taken of Thomas Field's personal estate, which should be used to pay his debts, funeral expenses and the cost of this suit. If there is not enough to cover them, then part of his real estate should be sold, but without prejudice to Ann Field's life estate. Any excess raised by the sale should go to John Field. - Joseph Margetts Pierson will join in any conveyance or surrender where necessary. Dated July 1751.
